TERMS OF SERVICE — LINKUP JAMAICA

1. About us

LinkUp Jamaica is operated by Verified Pro Jamaica Limited, a private limited company registered in Jamaica. We run an online marketplace at www.linkupjamaica.com and on the Google Play Store that connects trade professionals — contractors, technicians and skilled service providers — with customers across Jamaica.

We are a marketplace intermediary only. We do not employ providers or perform services. We facilitate the connection and hold payments in escrow until a job is confirmed complete.

2. Who these Terms apply to

These Terms apply to all users: customers who book services, providers who list services, and visitors who browse without an account.

By creating an account or using the platform, you confirm you are at least 18 years old, have legal capacity to enter a contract under Jamaican law, and agree to these Terms in full.

3. Account registration

You must provide accurate information when creating an account. You are responsible for all activity under your account. Notify us immediately at help@linkupjamaica.com if you suspect unauthorised access.

Providers must complete verification before their listing goes live: government-issued photo ID, trade certification from a recognised Jamaican body where required, NHT registration confirmation, and video verification through the platform.

Each person may hold only one customer account and one provider account. Creating multiple accounts to avoid a suspension is a breach of these Terms.

4. Providers are independent contractors

Providers are not employees, agents, or partners of Verified Pro Jamaica Limited. They are independently responsible for their own tax obligations, NHT contributions, NIS contributions, and any statutory requirements for self-employed persons under Jamaican law.

Providers must hold any licence or certification required by law for their trade, including but not limited to electrical work (Electricity Licencing Authority). Listing a service in a trade for which you hold no valid licence is a breach of these Terms and grounds for immediate removal.

5. Bookings

When a customer submits a booking and a provider accepts it, a binding service agreement is formed directly between the customer and the provider. The Company is not a party to that agreement.

Customers must make all payments through the platform. Customers must confirm job completion within 24 hours of the provider marking it done, or payment is released automatically. Providers must attend confirmed bookings or notify the customer and platform as early as possible.

Customers who cancel a confirmed booking within 24 hours of the start time may be charged a cancellation fee of up to 20% of the agreed job value. Cancellations with more than 24 hours' notice receive a full refund.

Providers who cancel a confirmed booking within 24 hours without a valid reason receive a reliability strike. Three strikes in 90 days may result in listing suspension.

6. Payments and escrow

All payments must be made through the platform. Customer payments are held in escrow until the job is confirmed complete. Provider net payment is processed within 3 to 5 business days after job confirmation.

PLATFORM FEES: Customers pay a service fee of 2% of the job value, added to the job price and shown clearly at checkout before payment. Providers pay a commission deducted from their payout before transfer: 4% of the job value for Rising Pro and Established Pro providers, and 3% for Elite Pro providers. The total platform fee on a completed job is therefore 6% (Rising and Established Pro) or 5% (Elite Pro).

Provider tier status is assessed automatically every quarter based on completed jobs and sustained review ratings. Established Pro requires 10 or more completed jobs with a 4.5-star average sustained over 90 days. Elite Pro requires 30 or more completed jobs with a 4.8-star average sustained over 90 days.

IMPORTANT: Paying a provider outside the platform — in cash or by direct bank transfer — voids all protections under these Terms including the LinkUp Guarantee. The Company accepts no responsibility for any off-platform payment.

The LinkUp Guarantee covers customers with a full refund if a provider fails to attend a confirmed booking. It does not cover disputes about work quality — those go through the dispute process in Section 7.

Customers and providers are each responsible for their own tax obligations. Provider income earned through the platform is taxable under Jamaican law.

BILLING CURRENCY: All platform charges — including provider membership and subscription fees, verification fees, and customer booking payments — are billed in Jamaican Dollars (JMD). The amount shown at checkout is the final JMD amount charged to you.

PAYMENT AUTHORIZATION: By submitting your payment card details, you authorize Verified Pro Jamaica Limited (trading as LinkUp Jamaica / linkupjamaica.com) to charge your Visa or Mastercard via our payment processor, Fygaro, for the amount shown at checkout, and, where you sign up for a recurring membership or subscription, for the recurring amount at the billing frequency stated at checkout until you cancel. Your card statement will display these transactions as LINKUP JAMAICA.

Refunds are governed by our Refund Policy, available at www.linkupjamaica.com/refund-policy.

7. Dispute resolution

Customers may raise a dispute within 48 hours of a job being marked complete. After 48 hours, payment is released and no dispute can be raised.

To raise a dispute: submit a written description of the issue, upload photo or video evidence where possible, and specify the resolution you are seeking.

The provider has 48 hours to respond. The Company reviews all evidence and issues a determination within 5 business days. Outcomes may include: full refund to customer, partial refund, full release to provider, or provider returns to remediate at no charge. The Company's determination is final within the platform's internal process and does not affect either party's right to approach the Consumer Affairs Commission of Jamaica or the courts.

The eight dispute categories are: (1) work not completed to standard agreed; (2) provider did not attend; (3) provider charged more than agreed; (4) property damage; (5) payment processing issue; (6) conduct complaint; (7) suspected fraud; (8) other.

8. Prohibited conduct

The following are grounds for immediate account suspension:

• Misrepresenting your identity, qualifications, or trade certification • Submitting false or fraudulent reviews • Taking bookings off-platform after making contact through the platform • Offering a licensed trade service without a valid licence • Harassment, discrimination, or threatening behaviour toward any user • Uploading illegal, defamatory, or infringing content • Attempting to access or interfere with the platform's systems • Creating multiple accounts to avoid a suspension • Any activity that violates the laws of Jamaica including the Data Protection Act 2020, Cybercrimes Act 2015, Consumer Protection Act 2005, or Electronic Transactions Act 2007

9. Ratings and reviews

Reviews may only be submitted by customers who have completed a booked transaction. Reviews must be honest and based on genuine experience. Reviews must not contain defamatory statements, personal attacks, discriminatory language, or commercial promotions.

Providers are assessed quarterly for tier status (Rising Pro, Established Pro, Elite Pro) based on sustained review performance.

10. Intellectual property

All platform content created by the Company is owned by or licensed to Verified Pro Jamaica Limited. By uploading content to the platform, you grant the Company a non-exclusive, royalty-free licence to display and use that content to operate and promote the platform. You retain ownership of what you upload.

11. Data protection

Verified Pro Jamaica Limited is registered as a data controller with the Office of the Information Commissioner (OIC) of Jamaica and complies with the Data Protection Act 2020.

We collect your name, email, phone number, government ID (providers only), payment information, and usage data. We collect this to operate your account, process payments, verify providers, and resolve disputes. The legal bases are contractual necessity and legitimate interest. Location data is collected only with your consent.

Your rights under the Data Protection Act 2020: you may request access to your data, request correction or deletion, withdraw consent at any time, object to direct marketing, and file a complaint with the OIC at www.oic.gov.jm.

We will notify the OIC of any data breach within 72 hours as required by law. We will notify affected users without undue delay. For all data requests, email help@linkupjamaica.com with subject line "Data Protection Request".

The platform is not for users under 18. We do not knowingly collect data from children.

12. Limitation of liability

The Company is not liable for the quality or safety of services performed by providers, property damage caused by providers, or any provider's failure to attend beyond the LinkUp Guarantee refund. Nothing in these Terms limits any right you have under the Consumer Protection Act 2005 of Jamaica. Where the Company is found liable, total liability shall not exceed the commission earned on the specific transaction giving rise to the claim.

13. Suspension and termination

The Company reserves the right to suspend or terminate any account — including provider accounts — for non-payment of platform fees, membership or subscription charges, breach of these Terms or platform rules, fraudulent activity, or harm to other users. Where possible we will notify you before permanent action. You may close your account at any time by contacting help@linkupjamaica.com. Closing your account does not affect pending payments or open disputes.

14. Governing law

These Terms are governed by the laws of Jamaica. The parties submit to the non-exclusive jurisdiction of the courts of Jamaica. These Terms constitute a binding electronic contract under the Electronic Transactions Act 2007. Creating an account is a valid electronic acceptance of these Terms.

Unresolved complaints may be referred to the Consumer Affairs Commission of Jamaica by any consumer.

15. Changes to these Terms

We may update these Terms. For material changes we will notify users through the in-app notification and by email, with at least 14 days' notice before changes take effect. Continued use after the effective date is acceptance of the updated Terms.
